Chapter I General Provisions
Article 1 in order to strengthen household waste management, improve the ecological environment and promote sustainable economic and social development, according to the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste and the regulations on the administration of urban appearance and environmental sanitation of the State Council These measures are formulated by laws and regulations such as the regulations of Anhui Province on the administration of urban appearance and environmental sanitation in combination with the actual situation of this city
Article 2 These measures are applicable to the release, collection, transportation, disposal and related supervision and management activities of domestic waste within the administrative area of this city
the term "domestic waste" in these Measures refers to solid waste generated in daily life or activities providing services for daily life, as well as solid waste regarded as domestic waste according to laws and administrative regulations
if laws, regulations and rules have other provisions on the management of hazardous waste, kitchen waste and recyclables in domestic waste, such provisions shall prevail
Article 3 the municipal domestic waste management adopts the principles of government leadership, territorial management, public participation, market operation and social supervision, and realizes the reduction, recycling and harmlessness of domestic waste through classified release, classified collection, classified transportation and classified disposal
Article 4 the municipal, county (city) and District People's governments (including the administrative agencies of the Development Zone, the same below) incorporate the management of domestic waste into the national economic and social development planning, determine the objectives of domestic waste management, coordinate the planning and construction of domestic waste collection, transportation and disposal facilities, and formulate and improve policies and measures for the reduction of domestic waste at the source and the release, collection, transportation and disposal
township (town) people's governments and sub district offices (including development zone communities, the same below) are responsible for the daily management of domestic waste in their respective jurisdictions, supervising and guiding Village (residents) committees to carry out the classification of domestic waste, and coordinating and solving specific problems in the process of domestic waste delivery, collection, transportation and disposal
Article 5 the municipal administrative department of urban administration is the competent department of domestic waste management in this city, which is responsible for formulating the objectives of domestic waste management and guiding, assessing and supervising the management of domestic wastethe county (city) and district urban management administrative departments are responsible for the management and supervision of the release, collection, transportation and disposal of domestic waste in their respective administrative areas
Article 6 the development and reform department is responsible for the approval, filing and approval of domestic waste related projectsthe ecological environment department is responsible for the supervision and management of the prevention and control of hazardous waste pollution
the supply and marketing department is responsible for supervising and managing the recovery and comprehensive utilization of recyclables
natural resources and planning, housing security and real estate management, urban and rural construction, public security, education, health, market supervision and management, culture and tourism, finance and other departments should work together to do a good job in domestic waste management within their respective responsibilities
Article 7 the village (residents) committee shall incorporate the source reduction and classified release of domestic waste into the village (residents) convention, do a good job in the publicity and guidance of domestic waste management, and mobilize and organize units and individuals under its jurisdiction to carry out classified release of domestic waste
owners' committees and property service enterprises should carry out the source reduction and classification publicity of domestic waste, guide and mobilize residents to release domestic waste by classification, and urge health and cleaning personnel to do a good job in the classified collection of domestic waste and the cleaning of domestic waste collection facilities in this area
Article 8 All units and individuals shall fulfill the obligations of source reduction and classification of domestic waste
Article 9 units and individuals that produce domestic waste shall pay domestic waste treatment fees in accordance with the charging standards of domestic waste treatment fees determined by the Municipal People's government and relevant regulationsArticle 10 encourage social capital to participate in domestic waste collection, transportation and disposal
encourage and support the scientific and technological innovation of domestic waste treatment, promote the research, development and application of new technologies and processes, and improve the scientific and technological level of domestic waste treatment
Article 11 this city implements a compensation system for the disposal of domestic waste in other places, and the counties (cities) and districts that export domestic waste disposal shall pay compensation to the counties (cities) and districts that import domestic waste disposal. The specific compensation measures shall be formulated by the municipal administrative department of urban administration in conjunction with the financial and ecological environment departments, and shall be implemented after being submitted to the Municipal People's government for approval
Article 12 The competent administrative department of urban administration shall do a good job in the publicity and mobilization of domestic waste management, improve the public awareness of the reduction and classification of domestic waste, and advocate an environment-friendly and healthy lifestyleeducation departments and all kinds of schools and kindergartens should strengthen publicity and education, and incorporate the knowledge of source reduction and classification of domestic waste into the educational content
newspapers, magazines, radio, television, Internet, outdoor advertising and other media should carry out public welfare publicity of domestic waste source reduction and classification knowledge
encourage environmental protection organizations and volunteers to organize publicity and mobilization of domestic waste source reduction and classified release, and participate in domestic waste classification volunteer service activities
Article 13 the municipal administrative department of urban administration shall, together with the departments of natural resources and planning, housing security and real estate management, urban and rural construction, development and reform, and ecological environment, prepare a special plan for the treatment of urban and rural domestic waste in the city, which shall be implemented after being approved by the Municipal People's government and announced to the publicwhen preparing the special plan for urban and rural domestic waste treatment in the city, we should scientifically consider the predicted production and composition characteristics of domestic waste, and clarify the overall layout of domestic waste facilities, land demand, funding guarantee and other contents
Article 14 the county (city) and district urban management administrative departments shall formulate the construction plan of domestic waste facilities in their administrative areas according to the special plan for urban and rural domestic waste treatment of the city, and do a good job in the construction of renewable resources sorting centers, large waste treatment plants and other facilities that match the delivery, collection, transportation and disposal of domestic waste
Article 15 the municipal administrative department of urban administration shall, together with the departments of natural resources and planning, housing security and real estate management, urban and rural construction, development and reform, formulate the construction specifications for the construction of supporting domestic waste classification facilities for construction projectsthe natural resources and planning department shall incorporate the relevant contents in the construction specifications of domestic waste classification facilities into the planning and setting requirements of municipal facilities (environmental sanitation facilities) supporting the construction project
the domestic waste classification facilities supporting the construction project should be designed, constructed and put into use at the same time as the main project
Article 16 the following units shall set up domestic waste collection facilities in accordance with the city's special plan for urban and rural domestic waste treatment and the specifications for the construction of supporting domestic waste classification facilities for construction projects:
(1) for the development and construction of new areas, the reconstruction of old areas and residential areas, the development and construction units shall set up domestic waste collection facilities
(2) public places such as airports, docks, stations, parks, shops, etc. shall be set up by the operation and management units
(3) the internal areas of state organs, enterprises, institutions and other organizations shall be set up by property rights units or use management units
(4) the built residential areas shall be set up by the sub district office or the Township People's government organized by the owners and property service enterprises
Article 17 No unit or individual may occupy or change the use of the land for domestic waste facilities determined in accordance with the general plan for land use and the urban and rural plan without legal proceduresArticle 18 No unit or individual shall dismantle, relocate or damage the domestic waste collection, transportation and disposal facilities without authorization
if demolition is necessary due to construction needs, the construction unit shall propose a demolition plan in advance and submit it to the competent administrative department of Urban Administration for approval
Chapter III source reduction and classified release
Article 19 state organs, institutions, social organizations, public place management units and other public institutions should save and intensively use resources, promote green office, give priority to the purchase of recyclable and resourceful office supplies, and reduce the consumption of disposable office supplies
Article 20 commodity producers and sellers shall strictly implement the provisions on restricting excessive packaging of products, mark the products and packages listed in the national compulsory recycling catalogue and specify the recycling methods in accordance with the provisions. Commodity producers and sellers are encouraged to take measures such as returning the deposit and exchanging the old for the new to recycle the products and packaging they produce and sellcatering, entertainment, hotels and other business service units should take environmental protection tips, price concessions and other measures to guide consumers to reduce or not use disposable products
supermarkets, shopping malls, market fairs and other commodity sellers shall not provide free or disguised free plastic shopping bags that do not meet environmental requirements to consumers. Encourage commodity sellers to provide plastic shopping bag substitutes that meet quality standards and environmental protection requirements
Article 21 this city promotes the listing of clean vegetables and the entry of clean agricultural and sideline products into the city
new farmers' markets and wholesale markets for agricultural products should be equipped with waste on-site treatment facilities at the same time; The established farmers' markets and wholesale markets for agricultural products shall realize the local and nearby disposal of wastes within three years after the implementation of these measures
Article 22 industrial associations of renewable resources, property management, express logistics, catering services, etc. shall formulate industrial self-discipline norms, guide and urge member units to do a good job in the source reduction of domestic waste
Article 23 domestic waste in this city is divided into recyclables, hazardous waste, kitchen waste and other waste, which are specifically classified according to the following standards:(1) recyclables refer to recyclable and resourceful paper, plastics, metals, textiles, electrical and electronic products, glass, etc
(2) hazardous waste refers to waste that causes direct or potential harm to human health or the natural environment, including waste batteries (except ordinary alkaline batteries), waste fluorescent tubes (fluorescent tubes, energy-saving lamps, etc.), waste thermometers, waste sphygmomanometers, waste drugs and their packaging, waste paints, solvents and their packaging, waste pesticides, disinfectants and their packaging, waste film and waste photo paper
(3) kitchen waste refers to the waste generated in residents' daily life, food processing, catering services, unit meals and other activities, as well as rotten vegetables, fruits, carrion, broken bones, eggshells, viscera of livestock and poultry products produced in farmers' markets and wholesale markets of agricultural products
